1. Agreement to Terms

By accessing or using LunarPay's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Description of Service

LunarPay provides payment processing services, including but not limited to:

• Invoice creation and management
• Payment link generation
• Recurring billing and subscriptions
• Customer management tools
• Transaction processing
• Payout services

3. Account Registration

To use our services, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

You must be at least 18 years old and have the legal capacity to enter into contracts to use our services.

4. Acceptable Use

You agree to use LunarPay only for lawful purposes. You may not use our services:

• For any illegal activity or to process payments for illegal goods or services
• To defraud or deceive others
• To violate any applicable laws or regulations
• To infringe on the intellectual property rights of others
• To transmit viruses or malicious code

5. Fees and Payments

LunarPay charges a transaction fee of 2.9% + $0.30 per successful transaction. Fees are deducted from each transaction before the remaining amount is made available for payout.

We reserve the right to modify our fee structure with 30 days' notice to existing users.

6. Payouts

Payouts are processed according to your selected payout schedule. LunarPay reserves the right to hold funds for risk management purposes, including but not limited to suspected fraud or disputes.

7. Refunds and Disputes

You are responsible for managing refunds and disputes with your customers. LunarPay may assist in dispute resolution but is not liable for chargebacks or customer disputes.

8. Privacy

Your use of LunarPay is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Intellectual Property

LunarPay and its original content, features, and functionality are owned by LunarPay and are protected by international copyright, trademark, and other intellectual property laws.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the service will cease immediately.

You may terminate your account at any time by contacting us. Upon termination, we will process any remaining payouts according to our standard schedule.

11. Limitation of Liability

In no event shall LunarPay, its directors, employees, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses.

12. Disclaimer

LunarPay services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, timely, secure, or error-free.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through our service. Continued use of the service after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
